Solutions

There are many different methods of resolving family law issues. Options include:

  • direct negotiation;
  • counsel negotiation;
  • mediation;
  • collaborative negotiation;
  • arbitration; and
  • court.

Methods for resolving family law issues can be more or less cost-efficient, time-efficient and amicable. You must select a method that is tailored to your individual needs. To do so, you must retain a lawyer with expertise and experience in a full range of dispute resolution techniques.

Mediation: Mediation is a dispute resolution technique in which you and your spouse work directly with a trained Mediator who will assist you in defining your issues, finding solutions to your disagreements and devising a plan for settlement of your family law affairs. Mediation is generally a cost-efficient way of settling Family Law issues. For more information please see www.themediationcentre.com.

Collaborative Family Law: Collaborative Family Law is a dispute resolution technique in which you and your spouse agree to keep your family law issues outside of the Court/adversarial process. Each of you will have a collaborative lawyer. The collaborative lawyers will assist you in defining issues, finding solutions to your disagreements and devising a plan for settlement of your family law affairs, in a civil, open and cost-effective manner. Court/Traditional Negotiations: Proceeding to Court is generally the most adversarial, time-consuming and costly technique to resolve Family Law issues. However, in some cases it is unavoidable. If proceeding to Court, you and your spouse should each retain skilled litigation counsel. You will then prepare and file required Court documentation and place your issues before a judge, for his/her  direction in relation to contested matters.

At Bair Family Law, we offer a full range of dispute resolution options, with highly skilled traditional negotiation and courtroom advocacy, along with specialized mediation and collaborative dispute resolution techniques.
